Terms & Conditions


  1. Contract of Sales
    1. All quotations, Sales Orders, Contracts related to the Services are bound by these General Terms & Conditions.
    2. In this Terms & Conditions, the following words shall mean: "Customer" refers to the person, company or other entity identified in the Customer information, or the party with whom the Sales Order or Purchase Order complete the Service requested herein. "Customer information" refers to the information that the Customer is required to provide for the Company to carry out the stipulated Services. "Company" refers to Artilux Sdn.Bhd. and/or its authorized representatives. "Service" refers to the Company's activities in relation to the provision and/or servicing of the Company's products, or any other products agreed upon with the Customer. "Contract" refers to the Sales Order, this General Terms & Conditions and other related written forms of communication including but not limited to Email, Whatsapp, SMS etc.
    3. Words in singular includes plural and words in the plural include singular.
    4. Time is essence.
  2. Delivery
    1. At least fourteen (14) business days from date of site measurement with customer confirmation on product selection and minimum deposit received by the Company.
    2. All installation appointments are subject to availability.
    3. The Customer is to ensure that the site is completely ready and clear of obstruction prior to measurement and installation appointments. Additional transport charges will be imposed for second trip.
    4. The Customer shall provide access for the Company to carry out its Services at any reasonable time and shall provide all facilities at the premises the Company may reasonably require to carry out the Services. Failing which, a new appointment shall be determined and additonal transport charges be imposed.
    5. Cancellation of installation appointment must be made at least twenty four (24) hours in advance on business day prior to the scheduled appointment. Transport charges shall be imposed if the Customer failed to observe an appointment.
    6. The Company shall endeavour to provide the Services at the time agreed with the Customer, howeverso shall not be liable for its failure to do so. The Company will notify the Customer at the earliest possible time shall a reschedule becomes necessary.
    7. Prices quoted include one (1) measurement trip and one (1) installation trip unless otherwise stated. Transport charges will be imposed for additional trips.
  3. Payment
    1. Minimum deposit payment of fifty percent (50%) of the final sales amount upon confirmation of order.
    2. Deposit paid is not refundable or transferable.
    3. Outstanding balance must be made in full at least forty eight (48) hours on a business day in advance prior to installation appointment.
    4. If payment is made by cheque or by any type of bank transfer, the payment shall not be considered to have been made until such time as the relevant amount has been cleared through the banking system into the Company's bank account.
    5. The Customer shall not deduct or withhold any payment (whether by the way of set off, counterclaim or otherwise) from any monies owing to the Company.
  4. Warranty
    1. Refer to Warranty Statement for detailed Product Warranty and Scope of Warranty.
    2. Warranty claims shall be in force upon full payment and with the presence of original invoice.
    3. Warranty is void if the Services are not performed by the Company's personnel or authorised agents.
    4. Warranty is void if the product is misused, abused or neglected.
    5. Product purchased for commercial used is excluded from this warranty.
  5. Exclusion from this warranty
    1. Cost of Service and/or replacement where faults are attributed to accident, fair wear and tear or misuse.
    2. Cost of Service and/or replacement where faults are attributed to repair and/or installation carried out by unauthorised person.
    3. Cost of Service where no fault is found with the product.
    4. Glass or infill panel breakage.
    5. Any scratches to the product which are not notified to the Company within three (3) business days upon installation.
    6. Damage to surface finishes and parts caused by construction and/or renovation site spillages and are carelessly treated or neglected.
  6. Force Majeure
    1. The Company shall not be liable to any delay or failure to perform any of its obligation if the delay or failure results from the events or circumstances of force majeure, including but not limited to acts of Gods, strikes, riots, fire, flood, accident, disease, the act or omission of government and etc.
  7. Others
    1. All sizes and prices are subject to final site measurement.
    2. Any variation(s) in product size, quantity and/or selection shall subject to requote.
    3. All ECO art panels design are single-sided only.
    4. Dismantle shall mean the unmounting of the intended subject only. Any other items whatsoever attached to the subject are excluded.
    5. Transport charges apply to some Klang Valley areas and locations outside of Kuala Lumpur.
    6. Products purchased are not refundable, returnable, transferable nor exchangeable.
    7. The Company reserves the rights to impose separate site measurement fees, transportation fees and/or admin fees in the event where the Service(s) performed deviates from the originally agreed Contract.
    8. The Company will exercise all reasonable skills and diligence in the discharge of the duties hereby covenanted to be performed but shall not be liable for any injury or damage whatsover caused to the Customer (or Customer's family member) or permises or the contents thereof by any act, neglect or omission on the part of the Company.
    9. The Customer shall hold harmless and release the Company against all liabillities for any unforeseen damages caused during performing the Service, including but not limited to damage to tile, plumbing, etc.
    10. The Company reserves the rights to offer alternatives of equivalent value in the event that the selected product is not available.
    11. The Company may collect and use Customer's information for but not limited to communication, customer service, marketing, promotion, publicity, testimony, survey or market research purposes, without prior notice and without compensation of any kind whatsover. The Company reserves the right to use any audio recording, visual recording, photographs, images, testimonials and content on the Company's social media platforms, whether produced by the Company or its appointed service providers, with reference to the Customer. By submitting your personal data, you consent to the use of that personal data as set out in this Policy as in accordance to the Malaysia Personal Data Protection Act 2010 ("PDPA").
    12. The Company reserves the rights to change the General Terms and Conditions herein without prior notice.
    13. The Contract shall not be affected in any way by the death or/and insanity or/and bankrupcy of the Customer.
    14. All prices quoted herein are inclusive of Sales & Service Tax (SST) where applicable. In the event that the Malaysian legislative body should amend or implement any domestic tax including but not limited to the aforesaid such tax shall be imposed on top of the current quoted price.
    15. This General Terms & Conditions shall be governed by and construed in all respect in accordance with the laws of Malaysia and the Customer hereby agrees to submit to the jurisdiction of the Courts of Malaysia in all matters arising out of or in connection with this General Terms & Conditions.
